Do I need to attend court in person, or can you appear for me?

For first mentions, adjournments and many guilty-plea hearings, we can appear under written authority or via Webex. You only need to attend if the magistrate specifically requires your presence, such as for sentencing, if you are on bail, or for contested hearings.

Can I avoid a criminal record for a first offence?

Yes, the court can order no conviction recorded under section 24 of the Sentencing Act 2017 if we can demonstrate there are good reasons not to record a conviction, such as a lack of previous convictions, youth, compelling personal circumstances, genuine remorse, rehabilitation steps and the impact a record would have on your employment or travel. Is there a work or special-hardship licence if I’m disqualified?

South Australia does not have a separate work licence that allows a person to drive only for employment. In eligible provisional or probationary licence matters, a driver may be able to appeal the disqualification to the Magistrates Court under s 81BB of the Motor Vehicles Act 1959 (SA). Will I go to jail for a first traffic or criminal offence?

Imprisonment is uncommon for first-time offenders unless aggravating factors exist, such as high BAC, serious injury, repeat offending, dangerous driving, serious violence or offending while on bail. Early mitigation, courses, restitution, counselling, references and careful sentencing submissions can help keep penalties to fines, bonds, licence loss or other non-custodial outcomes.
